186 Visa: EMPLOYER NOMINATION SCHEME (ENS)
The subclass 186 visa; Employer Nomination Scheme (visa subclass 186) is for skilled workers who want to live in Australia, and is part of the Permanent Employer Sponsored Visa Program.
This is a permanent residence visa, which can be applied for from both inside and outside Australia. If the applicant is in Australia, they must be in possession of a substantive visa or a bridging visa.
Who Is Eligible For The 186 Visa?
The Employer Nomination Scheme subclass (186) has three entry streams:
Stream 1: Temporary Residence Transition stream
This is for Temporary Work visa subclass 457 or TSS visa holders who have worked for at least three years in the same occupation with their nominated employer, who now wants to offer them a permanent position in that occupation
Stream 2: Direct Entry stream
This is for people who have been nominated by their employer under the Direct Entry stream, and who have never, or only briefly, worked in Australia. This could also be appropriate for temporary residents who do not qualify for the Temporary Residence Transition stream. The occupation must be on the relevant list of eligible skilled occupations.
Stream 3: Agreement stream
This option is for those who have been sponsored by an employer through a labour agreement.
The employer must be an approved employer.
What Are The Other Requirements Of The 186 Visa?
This visa is only available to a prospective migrant once they have been nominated by an Australian employer. The application must be lodged within six months of the nomination approval. The prospective migrant must also apply for the visa in the same stream and occupation that they were nominated in.
The prospective migrant may be able to apply for this visa if they fulfil the following requirements:
- Have been nominated by an approved employer within six months of application
- Are under the age of 45 (except in the case of exemption)
- Fulfill all the requirements, skills, and qualifications of the nomination
- Have at least Competent English skills (except in the case of exemption)
- Meet health and character requirements
- Meet the requirements of the stream in which they applied
The nominated position must:
- Be full time and ongoing for at least two years
- Be in the applicants field
- Offer a market salary rate
What Are The Benefits?
This visa allows the applicant to include a married or de facto partner, their dependent children, and other dependent family members who meet the requirements for including family members in the application.
Visa Charges
The Employer Nomination Scheme Visa has a base government charge of $4045 plus additional charges for each additional person included on the application.
